ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION AGREEMENT

I, as a participant (or parent/guardian of a minor participant), understand that South Mountain YMCA Camps takes reasonable precautions to ensure that its facilities, programs, and activities are conducted by qualified personnel in a safe and responsible manner. However, I further acknowledge and understand that participation in camp programs and use of camp facilities involve inherent risks, dangers, and hazards that cannot be completely eliminated.

These risks may include, but are not limited to: horseback riding (including the inability to predict a horse’s reaction to sound, movement, objects, persons, or animals, and hazards related to surface and subsurface conditions); ropes courses, climbing, and zip lines; swimming, boating, and water sports; land and field sports; target sports (including archery, trap, riflery, BB guns, and Archery Tag); overnight camping; bicycling; hiking; wagon rides and other forms of transportation; amusement park rides; bus trips; exposure to weather conditions; contact with plants and insects; uneven or rugged terrain; and other foreseeable and unforeseeable risks associated with outdoor and group activities.

I understand that these activities may result in injury, illness, property damage, or, in rare circumstances, death. I voluntarily and knowingly assume all such risks, both known and unknown, even if arising from the negligence of South Mountain YMCA Camps or others, to the fullest extent permitted by law.

In consideration for being permitted to participate in these programs and activities, I hereby release, waive, discharge, and covenant not to sue South Mountain YMCA Camps, its officers, directors, employees, agents, volunteers, and affiliates (collectively, “Released Parties”) from any and all claims, demands, damages, losses, or causes of action arising out of or related to my (or my child’s) participation, presence on camp property, or involvement in any camp-sponsored trips or activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

I further agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from my (or my child’s) participation in camp programs or my failure to follow camp rules, policies, or instructions.

I certify that I (or my child) am physically and mentally capable of participating in camp activities and agree to abide by all rules, policies, and instructions established by South Mountain YMCA Camps staff.

By submitting this form electronically, I acknowledge that this constitutes my legal signature. I further represent and warrant that I have the authority to sign on behalf of all participants included in my registration or party, including any minor children, and I agree that this agreement is binding on all such individuals.

I understand that by signing this agreement, I am voluntarily and knowingly accepting full responsibility for my (or my child’s) participation in South Mountain YMCA Camps programs and activities, and that I am giving up certain legal rights, including the right to bring a lawsuit.
